01Agreement
These terms are an agreement between you and Sebastian Tidwell ("we", "us") covering your use of sebastiantidwell.com, its REST API, its MCP server and any related tools (together, the "Services"). If you use the Services for an organisation, you accept these terms for that organisation too. If you do not agree, please do not use the Services.
How we handle personal information is explained in the Privacy Policy, which is part of these terms.
02Information only: not legal or professional advice
The Services provide general information, not legal, regulatory, tax or professional advice. Cannabis laws differ by state, change often, and remain illegal under United States federal law. State legal statuses, regulator resources, METRC bulletins, licence records and AI-generated answers on the site may be incomplete, out of date or wrong.
- Always confirm requirements with the official regulator and the original documents before relying on them.
- For decisions about your business or licence, consult a qualified attorney licensed in your state.
- Using the Services, or contacting us through them, does not create a consulting, attorney-client or other professional relationship. Consulting services are provided only under a separate written agreement.
Nothing on the site encourages or assists any activity that is illegal where you are. You are responsible for complying with the laws that apply to you.
03Accounts
You must be at least 18 to create an account. Keep your password and API keys confidential. You are responsible for activity under your account and keys, so tell us promptly if you think one has been compromised. Some tools are available only to accounts we grant access to, and we may change or withdraw that access.
04API and MCP server
We offer the API and MCP server free of charge, for use in your own apps, research and AI assistants, subject to these rules:
- Stay within the published rate limits, and do not try to get around them, for example by rotating keys or IP addresses.
- Keep your API keys private and do not share them. Each key identifies you.
- Do not use the Services to build a product that simply resells or mirrors them in bulk without our written permission.
- Where practical, credit sebastiantidwell.com when you publish data obtained from the Services.
We may change, rate limit, suspend or discontinue any part of the API or MCP server, and revoke keys, at any time. We will try to give notice of breaking changes on the API documentation page.
05Acceptable use
Do not:
- break the law, or use the Services to facilitate illegal activity;
- probe, scan or test the Services for vulnerabilities, or bypass security, authentication or access controls, except as part of good-faith security research that you report to us privately;
- overload or disrupt the Services, or scrape them at a rate that degrades them for others. Use the API instead;
- impersonate anyone, or misrepresent your connection with us or any regulator;
- send spam, malware or abusive, harassing or unlawful content through the contact form or any other feature;
- collect personal information about other users or licensed businesses from the Services for marketing, harassment or other misuse.
We may suspend or delete accounts and block access that we reasonably believe breaks these terms.
06Content and intellectual property
The site's design, code, themes, games, text and graphics are owned by Sebastian Tidwell or used under licence, and are protected by copyright and other laws. You may view and share pages for personal or internal business use, and link to any page.
Government material, such as METRC bulletins, regulator documents and public licence records, belongs to its original publishers. We republish it for convenience and claim no ownership of it. Third-party names and trademarks, including METRC, belong to their owners. Their appearance here does not mean they endorse us.
Some icons are used under the Flaticon/Freepik licence, credited in the site footer. One word list in the puzzle games is derived from SCOWL and used under its licence.
07What you send us
You keep ownership of what you send us, such as contact messages. You give us permission to store and use it to respond to you and to run the Services, as described in the Privacy Policy. Please do not send confidential or sensitive information through the contact form. If you send feedback or suggestions, we may use them freely without obligation to you.
08Third-party services and links
The Services link to, and some features rely on, services we do not control, such as state regulator websites, OpenAI (when you add your own key), map providers and your browser's push service. Your use of them is governed by their own terms, and we are not responsible for them.
09Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS. WE DO NOT PROMISE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY INFORMATION, INCLUDING AI-GENERATED ANSWERS, IS CORRECT OR CURRENT.
10Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, SEBASTIAN TIDWELL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, LICENCES OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICES, EVEN IF ADVISED THAT THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain exclusions or limits, so some of the above may not apply to you.
11Indemnity
If you use the Services in breach of these terms or the law, you agree to defend and compensate Sebastian Tidwell for resulting claims, losses and reasonable legal costs, to the extent the law allows.
12Ending your use
You can stop using the Services at any time, and ask us to delete your account as described in the Privacy Policy. We may suspend or end your access if you break these terms, or if we discontinue the Services. The sections on content, disclaimers, limitation of liability, indemnity and governing law continue to apply afterwards.
13Governing law and disputes
These terms are governed by the laws of the State of Oklahoma, United States, without regard to its conflict-of-law rules. Any dispute relating to the Services will be brought only in the state or federal courts located in Tulsa County, Oklahoma, and you and we consent to their jurisdiction. Before filing a claim, please contact us so we can try to resolve it informally.
14Changes to these terms
We may update these terms. The "Last updated" date shows when they last changed. If a change is significant, we will say so prominently on the site before it takes effect. Continuing to use the Services after a change means you accept the updated terms.
15General
If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these terms without our consent. These terms, together with the Privacy Policy, are the whole agreement between you and us about the Services.
